Realty Q&A: Any recourse for victims of mortgage bait-and-switch?

WASHINGTON (MarketWatch) — Question: I am writing for a friend who is in this country illegally. The couple took out a loan which they thought came with a fixed rate at 9.5% with no pre-payment penalty. Well, when they got to the closing (I know, as I questioned him ahead of time and I went to the closing), he was told that it was a variable rate loan that could not be refinanced for two years without incurring a large prepayment penalty. Do these borrowers have any recourse to get the terms of the prepay penalty waived? They put nothing down on a $100,000 loan and they earn only $20,000 to $22,000 a year. Helen.
